Nepal Adoption Requirements

Nepal Adoption Eligibility Requirements

In addition to the USCIS requirements for prospective adoptive parent(s), Nepal has the following eligibility requirements. If you feel you are not eligible to adopt or you are unsure, we may be able to work with you. Please contact us for a free case-by-case consultation.

  • Citizenship: One adoptive parent must be a U.S. citizen.
  • Age:  The age difference between the adoptive parents and the child to be adopted must be at least 30 years.  Single women must be between the ages of 35 and 55 years of age.
    • Prospective Adoptive Parents 30-45 qualify to adopt a child approximately 12 months old
    • Prospective Adoptive Parents 45-50 qualify to adopt a child between 13-24 months old
    • Prospective Adoptive Parents 50-55 qualify to adopt a child between 24-36 months old
  • Marriage Status:  Married couples are eligible to adopt if they have been married at least four years. Single women may adopt.
  • Previous Children:  Nepal requires that families with one child adopt a child of the opposite gender; two children of the same gender in the home is the limit to adopt a child of the opposite gender; families with no children can adopt a child of either gender. Families with two children of the opposite gender at home are not allowed to adopt from Nepal.  Parent(s) must apply for a child younger than that of the child they already have in their family.
  • Health:  Adoptive parents must obtain a document from a licensed physician that certifies they are healthy and able to parent a child. Parents with medical conditions that impede their ability to raise a child are not eligible to adopt from Nepal.
  • Income:  There is no minimum income required. However, you must meet the income requirements provided by USCIS for the child to immigrate.
  • Criminal History:  Applicants with a criminal history of child abuse, violence or domestic violence are not eligible to adopt.

Eligibility requirements are subject to change per Nepal’s adoption laws. CAN updates these guidelines as necessary.
